Oklahoma City, OK – Tribe appeal lawsuit decision

OKLAHOMA CITY (AP) The Osage Nation has filed an appeal of a federal court decision that rejected the tribe's attempt to exempt members who live and work in Osage County from state income taxes.

The tribe filed the appeal earlier this week with the 10th U.S. Circuit Court of Appeals. It seeks to overturn U.S. District Judge James Payne's ruling in the tribe's lawsuit against the Oklahoma Tax Commission.

The judge wrote in January's decision that the state of Oklahoma has governed Osage County for more than a century, yet the tribe hasn't sought to re-establish its reservation status or challenge the taxation until recently.

The tribe argued that Congress didn't officially dissolve the Osage Reservation and therefore the taxation of its members violates federal law.
