Tulsa, OK – TULSA, Okla. (AP) Eleven Arkansas poultry companies are accusing Oklahoma of foul play, saying the state is trying to introduce new research done by one of its expert witnesses.
The companies said Thursday that expert scientist J. Berton Fisher had a May 2008 deadline to submit a report of his findings, but went back months after to reevaluate some sampling locations to come up with a "new analysis."
Robert George, an attorney for Tyson Foods Inc., one of the companies being sued by Oklahoma, told a judge that his legal team only learned about the new findings 72 hours earlier.
Oklahoma attorney David Page said there would be no new analysis introduced.
Oklahoma is suing industry giants Tyson, Cargill Inc. and nine other companies over chicken waste pollution in the Illinois River watershed on the Arkansas-Oklahoma border.
