TULSA, Okla. (AP) — Two defendants in the robbery of a Radio Shack store Broken Arrow that prosecutors described as a "sophisticated takeover" operation will have to be retried after a federal judge declared a mistrial.
U.S. Chief District Judge Gregory Frizzell called a halt to the proceeding after he learned that the jury foreman discussed the case with someone against the judge's instructions. The foreman also didn't disclose he'd been the victim of an unrelated armed robbery.
The retrial for 22-year-old James Paul Wright and 24-year-old Wesley Ryan Wilson will start February 19th. They have pleaded not guilty, though two others charged have entered guilty pleas.
Prosecutors say that the robbers took workers at gunpoint into a back room and bound them with duct tape.
