The federal government replies to Oklahoma Insurance Commissioner John Doak’s assertion that he doesn’t have the authority to enforce the Affordable Care Act.
Authorities at the U.S. Centers for Medicare and Medicaid Services say they will be taking over enforcement of health insurance regulations under the Affordable Care Act.
Doak has said that he can’t legally enforce the law.
Federal laws don’t require states to enact the ACA’s changes to the health insurance system. But they do require CMS to enforce the healthcare reform law when states, like Oklahoma, don’t enact legislation or take any other action to implement the law’s consumer protections.
The CMS sent a letter to the Insurance Department this week stating that it will be taking over large parts of Oklahoma’s health insurance regulation.
